Terms of Service

1. Introduction

These terms of service ("Terms") govern your access to and use of eitri ("the Service"), operated by eitri ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. Service Description

eitri provides Linux virtual machine management over SSH, powered by cloud-hypervisor. The Service includes VM lifecycle management, networking, snapshots, cloning, volume management, and related functionality.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement.

4. Accounts

• You are responsible for maintaining the security of your account and SSH keys.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when registering.
• You must notify us promptly if you become aware of any unauthorised use of your account.

5. Acceptable Use

You may not:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to the Service, other accounts, or underlying systems.
• Interfere with or disrupt the Service or its infrastructure.
• Use the Service to distribute malware, send spam, or launch attacks against third parties.
• Resell or redistribute access to the Service without our prior written consent.
• Use the Service to mine cryptocurrency unless explicitly permitted by your plan.

We may suspend or terminate your access if you breach these terms.

6. Payment and Billing

• Fees are charged in advance on a recurring basis as described on our pricing page.
• All fees are exclusive of VAT and applicable taxes, which will be added where required.
• You authorise us to charge your chosen payment method for all fees due.
• If payment fails, we may suspend your access until the outstanding balance is settled.
• We may change our fees with 30 days' notice. Continued use after the change constitutes acceptance.

7. Refunds

If you are unsatisfied with the Service, contact us within 14 days of your initial purchase for a full refund. After this period, fees are non-refundable except where required by law.

8. Data and Content

You retain ownership of any data you store on the Service ("Your Content"). You grant us a limited licence to host, store, and transmit Your Content solely to provide the Service. We do not access Your Content except as necessary to operate the Service, comply with law, or respond to support requests you initiate.

You are responsible for maintaining your own backups. We are not liable for any loss of data.

9. Availability and Support

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice where possible. Support is provided on a best-efforts basis via the contact page.

10. Intellectual Property

The Service and its original content (excluding Your Content) remain our property. You may not copy, modify, or create derivative works of the Service except as expressly permitted.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

12. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

13. Termination

Either party may terminate this agreement at any time. You may cancel your account by contacting us. We may suspend or terminate your access with or without cause upon reasonable notice. On termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days after termination, after which it may be deleted.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via the Service. Continued use after changes take effect constitutes acceptance. If you disagree with changes, you should stop using the Service.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
